» AttorneysDealing with the passing of life and transfer of family assets is a process filled with emotional, legal and tax hurdles. Working with clients both before and after the deaths of family members we seek to help clients understand and move through the challenges, requirements and paperwork they must face.
There are a number of different ways assets may be transferred after a death. The method which must be followed after a death largely depends upon what was setup during lifetime. Many families are surprised to find out that active steps are needed to administer assets after a death no matter how much planning was done ahead of time. If a trust was drafted, active steps must be taken to transfer full authority to the new or surviving trustee. Often assets must be retitled into subtrusts to minimize current or future taxes, sometimes, even if there are no current taxes due, an estate tax return must be filed.
If an individual has passed without a trust, with an incompletely funded trust, with a will or without any planning documents at all, the decedent’s assets may be able to be transferred using simple declarations or may require a formal court proceeding known as probate. The Probate process can be a long one and special steps must be taken to prevent the process from encouraging family members to fight. When families are willing and able to work together, we are able to take steps withing a probate to shorten the process.
Property tax and estate tax (wealth transfer tax) issues often loom as night terrors for families faced with a loss. Our firm’s founder, Joel S. Weissler is a California Bar Board of Legal Specialization Certified Tax Law specialist. He has substantial experience helping families minimize taxes and their negative impact upon surviving family members.
The Weissler Law Group believes in a team approach to working with families. We are happy to work with our Client’s existing CPA’s and Financial Advisors throughout the administration process to make certain that all needs are thoroughly addressed in the most efficient and least painful way possible
Hours of work
Our Office is open Monday through Thursday from 9:00 AM through 6:00 PM and on Fridays from 9:00 AM to 5:00 PM. Attorney’s and Staff members are available after hours by special arrangement to accommodate the needs of extended families who are unable to meet during regular business hours.
